Overview of Your Rights as an Oregon Resident

The Oregon Consumer Privacy Act (OCPA) provides Oregon residents with specific rights regarding their Personal Information. In addition to having information about what Personal Information is collected, how it is used, and how it may be shared with others via our Privacy Policy (please follow the Residential Service Terms and Policies link on the bottom of every webpage to find), Oregon residents have the following five rights:

  • To confirm that TDS is processing your Personal Information and request to receive information regarding what Personal Information TDS is processing about you (Right to Access);
  • To request the erasure of your Personal Information held by TDS (Right to Delete);
  • To request to correct inaccurate Personal Information maintained by TDS (Right to Correct);
  • To request TDS limit the use of your Personal Information for Targeted Advertising or Profiling (Right to Limit Use);
  • To opt-out of the sale of Personal Information by TDS (Right to Opt-out of Sale); and
  • Appeal the outcome of one of the above requests (Right to Appeal).

Exercising Your Rights

Right to Access

Under the OCPA, Oregon residents and their authorized agents may seek confirmation that TDS is processing their personal information and request access to their Personal Information. If you are a current Oregon resident, you may use our Privacy Rights Request Form to request access to your Personal Information.

TDS must verify your identity before fulfilling your request. Please see information below about identity verification. For verified requests, we will provide you with a copy of your Personal Information collected and maintained by TDS. If TDS is unable to fulfill your request in its entirety, we will provide an explanation along with a partial response. The request will be fulfilled within 45 days of submission, or an extension notification will be provided.

Right to Delete

Under the OCPA, Oregon residents and their authorized agents may request the erasure of their Personal Information. If you are a current Oregon resident, you may use our Privacy Rights Request Form to request the deletion of your Personal Information by TDS and, if applicable, our Service Providers and Contractors.

TDS must verify your identity before fulfilling your request. Please see information below about identity verification. Please note that under certain circumstances, TDS is unable to delete information. For example, when your personal information is necessary to provide service or comply with law. If you request that we delete your information and we cannot, we will let you know what we did not delete and why.

Right to Correct

Under the OCPA, Oregon residents and their authorized agents may request the correction of inaccurate personal information maintained by TDS and, if applicable, our Service Providers and Contractors. If you are a current Oregon resident, you may use our Privacy Rights Request Form to request a correction. TDS must verify your identity before fulfilling your request. Your request will be fulfilled within 45 days of submission, or an extension notification will be provided.

Right to Limit Use

Under the OCPA, Oregon residents and their authorized agents may request that companies limit the use of their Personal Information for Targeted Advertising and Profiling as defined by the OCPA. If you are a current Oregon resident, you may use our Privacy Rights Request Form to exercise this right. Targeted Advertising as defined in the OCPA may also be done via technologies integrated into TDS webpages. Please use the banner that appears when using our pages to exercise your right to opt-out of those technologies. Please see the Cookies Preferences Section below for more information.

Right to Opt-out of Sale

Under the OCPA, Oregon residents and their authorized agents may direct TDS not to sell Personal Information to third parties. Third parties under the OCPA does not include trusted business partners who have access to personal information necessary to support TDS business purposes such assisting TDS to fulfill orders, process payments, and complete audits. These trusted business partners are prohibited from using or disclosing Personal Information for any purpose other than supporting TDS. If you are a current Oregon resident, you may use our  Privacy Rights Request Form to opt-out of the sale of your personal information to third parties.  TDS will verify your identity as necessary to fulfill your request. Verification

It is important that TDS verify your identity before fulfilling a request. If you sign-in via My Account before completing your request, you will be verified. If you are unable to do that, the form will guide you through the verification process.

TDS does not require you to create an account with us to make a request. However, for our customers with My Account, we recommend using this channel to authenticate your request as it will be the most efficient for you.

Agents authorized by the Oregon resident may act on their behalf. Agents include individuals with legal power of attorney and conservator. We ask the agent to verify your identity by providing us with certain Personal Information, depending on whether you hold an account with us or not and the nature of the information you require, which we will endeavor to match the information submitted to information we maintain about you. Additionally, we will require that you provide us with written confirmation that you have authorized the agent to act on your behalf, and the scope of that authorization. The agent will be required to provide us with proof of the agency relationship, which may be a declaration attesting to the agent’s identity and authorization by you to act on their behalf, signed under penalty of perjury. If the agent is a business entity, it will also need to submit evidence that it is registered and in good standing with the Oregon Secretary of State. Information to identify and verify your agent can be submitted through the same mechanism and while you submit information to verify your identity. Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney. Any such requests will be processed in accordance with Oregon law pertaining to powers of attorney.

Fulfillment Process

TDS will confirm receipt of your request and make an effort to fulfill verified requests within a reasonable time with the target of 45 days for a response. In some cases, we may need additional time to respond to Right to Access, Right to Correct, or Right to Delete requests. Should that occur, TDS will contact you so you know the reason(s) for the delay and when you can expect the request to be fulfilled.

Appeal Process

TDS has a process through which you may appeal the outcome of your Right to Access, Right to Delete, Right to Correct, Right to Opt-out of Sale, or Right to Limit Use requests. If you would like to appeal, please do so within 30 days and use the Privacy Rights Request Form to submit your appeal. We will act on your appeal within 45 days of receiving it.

TDS websites and mobile applications use our own cookies and may also use third party cookies. Through the use of cookies, Personal Information may be collected and then shared, disclosed, or transferred to others. If you wish to opt-out of cookies, please see the banner that appears on the bottom of TDS web pages to opt-out. Those requests will take effect immediately and without confirmation or correspondence from TDS.
